PUNITIVE-DAMAGES VACATUR AFFIRMED IN WHISTLEBLOWER SUIT VS. MARRIOTT

A Marriott subsidiary has successfully defended on appeal a trial judge's striking of a punitive damages award in an employee's whistleblower suit.

The employee, Dorothy Phillips, claimed Marriott Vacation Resorts International retaliated against her after she alleged that a fellow timeshare saleswoman was engaged in an improper financial relationship with a salesman who had been fired.

But Atlantic County Superior Court Judge William Nugent determined that while Marriott did retaliate against Phillips, conduct by upper management was not so egregious that there should be an award of punitive damages.
