A hot topic in the news recently has been whether employers are permitted to require employees or job applicants to provide them with their social media login information. Most often employers want this information because they want to ensure that either a new applicant or an existing employee is not acting in any way that could damage the reputation of the company. However, a number of states including New Jersey have made it illegal for employers to ask for social media login information. If your employer asks you to provide your login information I would strongly suggest that you contact an attorney to discuss your rights. We expect that over the next several months various other states will adopt similar laws making it unlawful for employers to request social media login information.
