Update: New Jersey's Stand on Employer's Right to Social Media Login Information

A hot topic in the news recently has been whether employers are permitted to require employees or job applicants to provide them with their social media login information. Most often employers want this information because they want to ensure that either a new applicant or an existing employee is not acting in any way that could damage the reputation of the company. However, a number of states including New Jersey have made it illegal for employers to ask for social media login information. If your employer asks you to provide your login information I would strongly suggest that you contact an attorney to discuss your rights. We expect that over the next several months various other states will adopt similar laws making it unlawful for employers to request social media login information.

If you would like more information about this topic or if you wish to discuss a legal matter with us, please do not hesitate to contact me at 973-949-3770 or via email at plamont@peterlamontesq.com. We answer legal questions on a daily basis and would be happy to discuss your matter with you.
